$4.7 billion in mj taxes for a schedule 1 drug

Some US citizens are currently incarcerated for life for accepting much much less $ in mj sales.
Once the feds accepted this mj tax money as legal tender, were they committing money laundering crimes for that total amount?
My solution to this problem is to change federal law to declassify mj as a schedule 1 drug. Give mj the title it deserves (finally). Maybe then the gov. could potentially legally accept the tax money for mj sales. Or they can always choose to give the $4.7 billion back to the rightful owners of that money (that will be the day...). Should the individuals responsible in the appropriate departments of government face the same prosecution as the ordinary citizens of this nation would for accepting money from mj sales?
Care to share your thoughts?
 
The fact that cannabis is still classified as a sched. 1 drug makes it clear that a lot of folks are making mega-bucks by keeping it sched 1. Big pharma is just the tip of the iceberg in that sense.
 
Yeah, it's all about keeping everyone on opiates. It's sad when you start looking into the history with opiate / cannabis connection, not to mention all of the other racist nonsense that contributed to this as well. There is no legit reason to have this as schedule 1, but yet nobody has changed it. The FDA is such a damn joke as well. They try to say there is no benefit to MJ, but then back in the day every single pharm company was making cannabis products. Talk about a contradiction, it sucks there is absolutely nothing we can do about it either. Just have to keep getting fd over and wait for a president that will finally take the first step. How in the world in Xanax schedule 4, a drug that is HIGHLY addictive and will kill you easily if mixed with alcohol or opiates. Now there is a drug that has no real medical benefit. All it's really good for is helping someone who took too much LSD or someone who suffers from panic attacks and even then you have much better and safer options.
 
When the MJ tax revenue surmounts revenues from the pharmaceutical industries you can bet your posterior MJ will lose its schedule one classification. Dot gov will wants its piece of the action. Always, always follow the money. We live in a dictatorship of capitalism that sets the parameters for every avenue of your life!
 
But Hurst's paper mills may have lost money or went under, and the cotton industry would have been hurt,,, whatever!! I mean do I care what the paper I write on is made of, trees or hemp (hemp grows faster)? Must I have cotton for my T shirt, or could I were a hemp shirt as easily (and comfy)?

There is a bill being worked on for the gov to get out of the way, I am sure it will mean new taxes as well. Dont hold your breath, getting the gov to do anything is like poring cold molasses out of the jar,,,,
 
Well said. But I disagree about us not being able to do anything: look at how things are changing all around the country! In the super redneck states like mine, we still have to continue to pressure our elected officials to start by legalizing medical mj.

But what will happen to the alcohol industry and big pharma (shit like Xanax) when cannabis is legal everywhere? There are a lot of seriously protected interests in the iceberg I mentioned in my first post above.

I once heard of you hired a man with a lawnmower to cut your lawn, the government would hire 100 men with nail clippers to do the exact same job. Lol
 
It has been legalized at the federal level and is considered a crop that can be transported across state lines, as for being arrested that is always a possibility, but if one has a license to cultivate hemp as such the burden of getting a conviction would be on the state to prove the hemp had more than 5% THC in it.
 
The max allowable thc for cbd and hemp crops is .35%. Trust me I know as I have a license to grow, transport, and distribute hemp/cbd flower. I am still waiting for the first harrasment by officers.
 
You are correct, my error, my confusion was Florida was trying to limit THC in MMJ first to 5% which failed out of the box and then then 10% which also was voted down.

Cultivators where fighting both bills as it would seriously complicate their work with all of the testing and record keeping requirements.

By they way I hope they have enough common sense to stay off your back and just let progress and capitalism work.

Sadly it seems too many politicians and their charges have watched Reefer Madness a few too many times and really believe it to be true.
 
Always a possibility? Really? I have never heard of tobacco farmers getting arrested for levels of nicotine in their product.
Actually, the state doesn’t have to prove how much THC. It’s the company’s burden to provide proof of testing the batches. The DA says, police did a field test and the substance contained THC. The end.
The state of Idaho’s official position is transporting any amount of THC (hemp or not) violates local state law.
Not to mention the fact that the police in charge of doing the testing and arresting have no way to define hemp from high THC Mj currently. So all hemp will test positive, and there for it is not legal to transport in that particular state.
This guy mentioned in the article got a felony for transportation of hemp in Idaho. This occurred after it was deemed legal on the federal level. So I don’t think the assumption of safe crossing hemp across state lines accounts for all local state laws.

If that is the bust I am thinking of it happened a month before the Farm Bill was passed making interstate transport legal nationwide.
 
Finalized bill in Dec 2018. Bust happened in Jan 2019. One month after the signing.

The law protects cannabinoids derived from hemp but not mj. Since there is no way to prove that with a field test device, all hemp could potentially be considered illegal (when only field testing is considered).
You would have to get the arrest tossed out by proving to a court that you only have hemp. There would need to be third party lab testing done at your expense to be considered. The arrest will remain on the permanent record until expunged.
This is not how I define legal.

Yes as far as that goes the state comes and tests 2 samples of your crops to test the thc. If its over .35% you have to destroy the crop.

That being said if the police are the ones dealing with it all they see as Toker states is that it tests positive for THC. They dont have a way at this moment to test how much thc at the street level. So they will most likely arrest you and let the courts figure it out. Being innocent of a crime is not going to stop them from arresting you. Yes you will later be able to prove you were not committing a crime and it will be dismissed. But that is after you spent time money and frustration to prove it. You cant get that back. Its a crap shoot until officers have a way to test thc level instantly.
 
I believe LEO tests will be forced into showing THC levels the same as breath tests already do, all it will take is a few false arrests law suits against the departments making the arrests.
